Juli 2019, in Luxemburg ein Grundsatzurteil gef\u00e4llt. Es geht um die Kulturtechnik des Sampling. Das zukunftsweisende Urteil erlaubt es, fremde Aufnahmen ohne Genehmigung zu nutzen \u2013 zumindest, wenn sie hinreichend verfremdet sind. Seit 20 Jahren auf der Anklagebank: der Produzent Moses Pelham, der von der Band Kraftwerk der rechtswidrigen Nutzung eines zweisek\u00fcndigen Beat-Fragments ihres Werkes \u201eMetall auf Metall\u201c bezichtigt wird. Pelham hatte die Passage f\u00fcr Sabrina Setlurs Song \u201eNur mir\u201c unlizensiert gesamplet.<\/p>\n<p>Der Bundesgerichtshof hatte 2008 zugunsten der Elektronik-Pioniere aus D\u00fcsseldorf entschieden. 2016 widersprach das Bundesverfassungsgericht diesem Urteil, da der Urheber \u00fcber keine \u201eVerbotsmacht\u201c verf\u00fcgen d\u00fcrfe. Bisher hatte die EU eine strenge Haltung, zum Thema Sampling vertreten. Das heutige Urteil des EuGH ist wegweisend f\u00fcr zuk\u00fcnftige Urheberrechtsklagen.<\/p>\n<p>Die Entscheidung bedeutet aber nicht, dass Sampling zum rechtsfreien Raum wird. Damit ein Sample ohne Erlaubnis straffrei bleibt, ist Voraussetzung, dass es nicht wiedererkennbar ist. Ob das f\u00fcr die Causa \u201eNur mir\u201c zutrifft, muss nun der BGH f\u00fcr den konkreten Fall entscheiden. Auch in der zweiten Ausgabe <a href=\"https:\/\/www.byte.fm\/blog\/news\/bytefm-akademie-sampling-90514\/\">der ByteFM Akademie<\/a>, die am 20. und 21.
